After declaration of Rajasthan High Court on illegal and void of Jal Mahal land deal, state government now moved to the Supreme Court to seek a right of pre-audience.
A division bench of the apex court on Wednesday heard arguments of Attorney General (AG) of India appearing for the state of Rajasthan on the mired deal of 100 acres of wet land (lake bed) of Mansagar lake situated in Jaipur to Navratan Kothari, owned Jal Mahal Resorts Pvt. Ltd. The lake and its structures form part of protected monument popularly known as Jal Mahal.
The matter being heard by the division bench for quite some time and the arguments on behalf of the beneficiary company were to be concluded on Wednesday but before it could happen, the state government taking a lead in the matter requested the bench for giving it a right of first audience.
AG G E Vahanvati who has a right of first audience in a court put his appearance for the state government. The matter was heard at length and the arguments could not be closed.
“If the government was so keen to see the outcome of appeals, it should have argued the matter at the first instance and now when the elections are approaching, the strategy adopted by the government raises doubts over the manner and intent with which the appeals are being conducted,” said Ajay Kumar Jain, counsel for other PIL petitioners before the high court.
“It would hardly make any difference to the merit of the case as the issue to be addressed are common in all the appeals,” says Aruneshwar Gupta, counsel for the one of the PIL petitioners of the bunch of appeals in the Supreme Court.
