Rajasthan HC declares Vidhyarthi Mitra Scheme illegal

After Jodhpur bench of the Rajasthan High Court, single bench of Justice Manish Bhandari at Jaipur also declared the Vidhyarthi Mitra Scheme illegal. Rajasthan High Court said that the Rajasthan Subordinate Service Rules and Panchayati Raj Rules do not provide for appointment of such ‘Mitra’.

The court also said that regular appointments should be made for these posts. In its decision, the court said the decision on the appeal pending in the main bench will also be applicable to the petitioners.

The single bench of Justice Manish Bhandari passed the order, rejecting the petition by Mahendra Singh and other three dozen petitions.

Notably, in the Jodhpur bench of the Rajasthan High Court had already held this scheme as illegal on October 21.

In the petition, it was said the petitioners have been employed as Vidhyarthi Mitra on contract for the last five years and the contract ends in April 2014.

Due to the appointment of permanent candidates, the contractual employees are being removed.

Meanwhile, the state government also informed the court that there was no provision of the appointment of Vidhyarthi Mitra in the rules and the main bench has already held the scheme as illegal. On this, the court ordered to implement the decision of the main bench and held the scheme as illegal.
